Got Questions?

USA Filing & Taxation Frequently Asked Questions

Clear answers to the most important questions regarding US LLC taxes and compliance.

Yes, absolutely. Under IRS regulations (Section 6038A), every foreign-owned US Single-Member LLC is legally required to file Form 5472 and Pro Forma 1120 even if the business generated zero revenue or had zero profit. Failing to file triggers an automatic $25,000 IRS penalty.

IRS Form W-7 is the official application used by foreign non-residents to obtain an Individual Taxpayer Identification Number (ITIN). An ITIN is required to file personal non-resident tax returns (Form 1040-NR), open US merchant accounts (PayPal US, Stripe), and build US personal credit. We file Form W-7 through our Certified Acceptance Agent (CAA) service, which certifies your passport remotely so you never have to mail your physical original passport to the US.

Generally, a US Single-Member LLC owned by a non-resident is treated as a "disregarded entity" for tax purposes. If you do not have physical operations, US employees, or a physical office in the US (known as "ETBUS" - Engaged in Trade or Business in the United States), your profits are considered non-US sourced and are typically not subject to US federal income tax. However, you MUST still file Form 5472 informational return to maintain legal standing.

The annual deadline for Single-Member LLCs is April 15th of each calendar year following the tax year. For Multi-Member LLCs (Form 1065), the deadline is March 15th. We can also file an official 6-month extension on your behalf (to October 15th or September 15th) if you need additional time to prepare financial records.

If you fail to file your State Annual Report (such as in Wyoming or Delaware), the state will assess late fees and eventually administratively dissolve your LLC. Once dissolved, your corporate entity loses legal liability protection and your US business bank accounts (Wise, Payoneer, Stripe) will be frozen.

Yes. For Amazon sales, Amazon automatically collects and remits sales tax under Marketplace Facilitator laws. For Shopify and direct e-commerce, we help analyze your economic nexus, set up automated tax collection, and issue State Resale Exemption Certificates to purchase supplier inventory tax-free.
